Hong Kong News: Updated Guidelines for Visa Extensions in Hong Kong
The Hong Kong Immigration Department has introduced updated regulations for visa extension applications, requiring applicants to manage their timelines more proactively to maintain residency status.

Key Regulatory Changes
- Mandatory Departure: Under the new rule, if an extended visa is not approved before the current visa expires, the applicant must leave Hong Kong by the expiration date.
- Previous Practice: Previously, applicants could remain in Hong Kong while awaiting a decision, provided they had submitted their extension application before their current visa expired.
- Flexibility: While you must leave if your visa expires, the department confirms you may re-enter later as a visitor to await approval or collect the extended visa.
Extended Submission Window
To mitigate the risk of needing to leave, the Immigration Department has significantly expanded the application window, effective since March 1, 2026:
- New Policy: Eligible applicants can now submit extension requests up to three months before their current visa expires (previously, this was limited to four weeks).
- Recommended Timeline: The Department advises submitting applications at least six weeks before expiration to allow sufficient processing time.
Affected Visa Programs
This policy update applies to holders of the following schemes (and their dependents):
- General Employment Policy (GEP)
- Admission Scheme for Mainland Professionals and Talents (ASMTP)
- Admission Scheme for Technology Talents (TechTAS)
- Immigration Arrangement for Non-local University Graduates (IANG)
- Admission Scheme for Highly Skilled Migrants (QMAS)
- Admission Scheme for Second-Generation Chinese Residents (ASSG)
Note: "Top Talent Pass" visa holders have been eligible for the three-month window since November 2024.
Important Considerations for Residency
While the new policy grants more time to prepare, it also imposes stricter requirements on those who delay their applications.
A significant concern is the continuity of "habitual residence." If there is a gap between the expiration of your original visa and the issuance of an extension—during which you are required to be outside of Hong Kong—it could disrupt your continuous residence record. This may negatively affect your future eligibility for a permanent residence permit.
Recommendation: Employers and visa holders should monitor expiration dates closely and submit extension applications well in advance to prevent any disruption to employment, residency, or long-term immigration goals.
